Al Franken Wins: a Fair and Balanced Update
The suit filed by Fox News against comedian Al Franken was dismissed today by U.S. District Judge Denny Chin.
Chin, who dismissed the case on the grounds that Franken’s book is parody and protected by the First Amendment, called Fox’s suit “wholly without merit, both factually and legally.” The judge went on to state that Fox’s trademark on “Fair and Balanced” is itself weak because the words are so commonplace.
In the suit, Fox News called Franken “a C-level political commentator” who “appears to be shrill and unstable” and who’s “views lack any serious depth or insight.” While the same could be said of the commentators on Fox News, Franken exercised admirable restraint by not shouting “I know you are, but what am I?!” In fact, he actually expressed gratitude to Fox News for filing this ridiculous suit.
